Clarity Act passage hinges on secret Trump crypto ethics deal

The fate of the Digital Asset Market Clarity Act rests on an undisclosed ethics agreement brokered by Donald Trump, creating a high-stakes legislative scramble ahead of an August 7 Senate deadline.

The White House is pressuring Senate Democrats to accept a confidential conflict-of-interest agreement negotiated by President Donald Trump to break a final legislative logjam on the Digital Asset Market Clarity Act. The administration is framing the concession as a historic compromise, though Democratic negotiators have not been briefed on its contents.

A White House official claimed Trump “has agreed to the most comprehensive and wide-ranging ethics provision in history.” The exact crypto restrictions remain unknown, and release of the final legislative text has stalled for days as lawyers draft the language.

The secrecy surrounding the provision is a direct response to Trump’s deep financial ties to the sector. The president’s family crypto holdings have generated more than $2 billion in new wealth since he took office, and Trump recently disclosed making over $1 billion from crypto in 2025 alone.

Democratic senators involved in the negotiations, including Kirsten Gillibrand, Ruben Gallego and Angela Alsobrooks, have drawn a hard line demanding a robust ethics framework. Both Gallego and Alsobrooks previously advanced the bill out of the Senate Banking Committee in a 15-9 vote, but warned they would oppose final passage without such provisions.

For market participants, the Clarity Act represents the most significant attempt yet to establish a regulatory perimeter for digital assets in the United States. However, the current standoff introduces acute policy risk for investors, as the ethics provision is meant to govern the very industry from which the president has profited massively.

Republicans and the crypto industry are attempting to shift the blame for any delay onto Democrats. “If Senate Democrats block this historic legislation after the administration has bent over backward to accommodate their concerns, stakeholders should make no mistake: It is the Democrats who are blocking this legislation because they were never serious about a legislative outcome,” the White House official said.

Treasury Secretary Scott Bessent urged swift action, telling lawmakers they stand at the “1-yard line.” The industry expects full circulation of the text this week, giving the Senate fewer than three weeks to clear a floor vote before Majority Leader John Thune’s August 7 recess deadline. Galaxy Research currently puts the odds of passage at 50-50.
